2. Quality Commitment
Profound Analytics commits to delivering Training on a commercially reasonable efforts basis, ensuring quality and relevance.
3. Training Details
Training will be delivered as specified on our Website, including dates, times, and modalities (online or, if applicable, in-person). Regular office hours for in-person Training are from 8:30 AM to 5:30 PM, Monday through Friday, excluding Netherlands public holidays.
4. Fees and Payments
- Fees: All Training fees, including those for relevant materials and tools, are clearly listed on our Website. It's important to note that these fees are exclusive of VAT. In the final step of the payment process, a standard VAT rate of 21% will be applied on top of the listed fee, in accordance with Dutch tax laws.
- Payment Method: We accept payments exclusively via credit card. When you proceed to the payment step, the applicable 21% VAT will be calculated and added to the total amount. The total cost, including VAT, will be displayed before you confirm the payment, ensuring full transparency.
- Non-payment: Access to Training is contingent upon successful payment. Should there be any issues with your credit card payment, we kindly ask you to resolve them promptly to secure your enrollment in the desired Training session.
5. Cancellations and Refunds
- A 7-day withdrawal period from the Training enrollment date is offered, allowing for rescheduling or cancellation.
- However, clients may cancel their enrollment only up to 10 days before the start of the course. Cancellations within 10 days of the course start date are not permitted.
- We reserve the right to cancel or reschedule Training due to unforeseen circumstances, providing as much notice as possible. In such cases, participants will be offered the choice to reschedule to a new date or cancel their enrollment with a full refund.
6. Intellectual Property Rights
All content, including Training materials, e-books, and Python codes, provided on maryammiradi.com or during our Training sessions, is the exclusive property of Profound Analytics B.V. or its licensors. This encompasses all forms of intellectual property, including but not limited to texts, graphics, logos, and software code.
Participants in our Training sessions are granted a non-exclusive, non-transferable, non-sublicensable right to use the Training materials and Python codes for their personal, non-commercial development purposes only. This right is strictly limited to personal use, meaning:
- Prohibited Actions: Distributing, sharing, or making the Python codes or any other Training materials available to others in any form, including but not limited to publishing on websites, forums, social media platforms, or any digital or physical medium, is strictly forbidden.
- Code Usage: The Python codes provided as part of the Training are for individual educational use only. Participants may not use these codes for commercial purposes, nor may they integrate them into commercial products without explicit written permission from Profound Analytics B.V.
- Confidentiality: Participants must treat the Python codes and Training materials as confidential information, applying the same degree of care as they would to their confidential information, but in no event less than reasonable care.
Violation of these Intellectual Property Rights will lead to immediate revocation of the Training participation rights and may result in legal action to enforce these rights and seek damages.
7. Confidentiality
Both parties agree to treat each other's confidential information with the same degree of care as their own. Confidentiality obligations survive the termination of these terms for a period of three years.
8. Data Protection
We respect your privacy and commit to processing your personal data in accordance with our Privacy Policy. For Trainings requiring personal data processing, we adhere to applicable data protection laws and maintain technical and organizational measures against data loss or unauthorized processing.
9. Liability Limitation
- Limitation of Liability: Profound Analytics B.V. (the "Company") shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.
- Direct Damages: Our total liability for any claim under these terms, including for any implied warranties, is limited to the amount you paid us to use the applicable service(s) in the 12 months before the claim.
